Responsible for overseeing employee relations within a designated group of Departments/Units at MCS. The HRBP collaborates with leadership to ensure that Human Resources strategies align with the organization's business objectives and overall strategic plan, fostering a supportive and effective work environment. Additionally, the HRBP provides guidance on HR matters, helping to drive initiatives that support both employee development and organizational success.
ESSENTIAL FUNCTIONS:
o Advise and support management on employee relations matters and conflict resolution between employees, ensuring effective, objective, and consistent solutions are implemented in line with best practices and organizational policies.
Guide management in performance management processes, including progressive discipline, performance evaluations, and performance improvement plans, to optimize workforce performance and ensure MCS achieves its goals and productivity targets.
Provide guidance to management and employees on HR compliance with company policies, occupational health and safety programs, and relevant labor laws, while directing employees to appropriate HR departments as needed.
Support the Senior HRBP in managing Employee Relations investigations, addressing employee grievances from various sources (employees, witnesses, confidential reports), and ensuring adherence to MCS's investigation policies and procedures.
Collaborate with the Reasonable Accommodation Committee to assess accommodation requests, ensuring compliance with the ADA, applicable local laws, and MCS's Reasonable Accommodation Policy.
Advise management on MCS's disciplinary procedures, helping determine the appropriate disciplinary actions for each case. Assist with writing, reviewing, and approving disciplinary documentation, and maintain accurate records in the Disciplinary Log.
Analyze investigation reports related to compliance issues, legal security, privacy, and IT security incidents, advising management on the necessary disciplinary actions according to company policies. Document all related cases in the Incident Log.
Manage and activate MCS protocols for sensitive issues (e.g., Domestic Violence, Sexual Harassment, Workplace Harassment, Sexual Orientation and Gender Identity) to ensure confidential documentation of interviews and the development of appropriate security plans.
Handle medical emergencies according to established procedures and ensure accurate case documentation in the relevant logs.
Represent the company in hearings and interactions with government agencies, such as the Department of Labor, ensuring the accurate channeling of information for case resolution.
Maintain up-to-date dashboards and reporting logs for the Employment Relations Unit, including detailed information on privacy incidents, compliance issues, lawsuits, leave of absence, terminations, investigations, disciplinary actions, and accommodations.
Ensure that all required reports and logs meet established quality parameters and are delivered on time to ensure compliance with internal standards and external regulations.
o Must comply fully and consistently with all company policies and procedures, with local and federal laws as well as with the regulations applicable to our Industry, to maintain appropriate business and employment practices.
May carry out other duties and responsibilities as assigned, according to the requirements of education and experience contained in this document.
MINIMUM QUALIFICATIONS:
Education and Experience:
Bachelor's degree in Human Resources, Labor Relations, Industrial Psychology, Business Administration, or related areas. At least three (3) years of experience performing similar tasks from
the perspective of Human Resources (consultant, or management consultant). Proven experience in employee relations, conflict
management, and the application of progressive discipline.
"Proven experience may be replaced by previously established requirements."
Certifications / Licenses:
PHR/SPHR/GPHR or Human Resources certification is highly desirable.
Others:
Deep knowledge and understanding of Puerto Rico and federal employment laws and regulations and extensive knowledge of procedures, techniques, and efficient strategies of human resources management. Special knowing of EEO, AAP, FLSA, OSHA, ADA, ADAAA, Maternity and Religious Accommodation and FMLA regulations among others.
