Job Description




What you would be doing:

Under the direction of the Executive Director, the Law Specialist provides legal assistance in support of functions of the Commercial Fisheries Entry Commission. Performs varied administrative, policy related and substantive legal duties with a high degree of responsibility; represents the Commission in relationships with the public and the Alaska Department of Law. Drafts Commission decisions, conducts legal research, establishes and maintains Commission regulatory and legislative archives. Drafts regulatory proposals, and writes statutory amendments for introduction by the legislature.

This position is primarily responsible for management of information and communications relating to legal aspects of limited entry. It is responsible for representing the Commission with the Alaska Department of Law, providing information and legal research to the Commissioners and staff regarding litigation, coordinating the promulgation of regulations, and performing policy analysis in support of the Commissioners and Commission paralegals.

Examples of Duties:
Legal Services

Provide administrative support to Commissioners during fishery litigation process.

Evaluate proposed investigations for further action and approve settlements in notice to show cause hearings. Hearings & Adjudications

Draft Commission decisions and perform legal research in support of decisions.

Coordinate record preparation for appeals process.

Act as Hearing Officer, as needed, for hearings relative to: limited entry permit applications; qualifications for an interim-use permit; emergency and permanent transfers of permits; entry permit fees based on residency and on poverty fee guidelines; refunds of permit fees; demerit points; notice to show cause (AS 16.43.960).

Review hearing requests to determine if there is a genuine issue of fact, law or discretion that could be addressed at a hearing and issue decision.

Schedule and conduct hearings. If needed, arrange prehearing conferences, issues subpoenas, and rule on motions.

Issue preliminary orders; write and issue hearing decisions.

Limitation of Fisheries

Provide analysis and support of all aspects of limiting a fishery under the Limited Entry Act. Regulations

Prepare public notices and agendas for public meetings of the Commission.

Administer all aspects of the Commission\'s regulatory process.

Liaison

Act as liaison between Commission and Attorney General\'s Office for appeals, regulations, legislation, and AG opinions; provide information and assistance, as needed.

Perform legislative liaison responsibilities, as needed. Policy

The Organization\'s Purpose:

The Alaska seafood industry is one of the state\'s leading economic sectors bringing in over $5.5 in economic activity and employing over 60,000 people. With fisheries that range from Ketchikan to Kotzebue, annually there are more than 12,000 people who renew almost 18,000 permits. The Alaska Commercial Fisheries Entry Commission (CFEC/Commission) is the agency responsible for issuing those permits and getting Alaska\'s commercial fishing industry on the water. The Commission perform a variety of judicial and regulatory functions. The Law Specialist is the chief legal advisor on all Commission matters.

Our Team:

CFEC is a small, quasi-judicial agency with a close-knit group of professionals. CFEC is an independent agency, separate but affiliated with the Alaska Department of Fish and Game. As chief legal counsel for the Commission, this challenging position offers work in a variety of interesting fisheries management and marine legal arenas.

The Working Environment:

The position works in Juneau, Alaska in a centrally located professional office complex, approximately 8 miles from downtown Juneau. This position may be availed to a hybrid in-office/telework agreement if appropriate.

  • represents the Commission in relationships with the public and the Alaska Department of Law;
  • drafts Commission decisions, conducts legal research, and establishes and maintains Commission regulatory and legislative archives; and
  • drafts regulatory proposals, and statutory amendments for introduction by the legislature.
This position requires knowledge in or of the Limited Entry Act and regulations, objectives, and procedures; familiarity with law, legal research and legal procedures; the ability to analyze complex issues; and the ability to maintain sensitive information in confidence. Candidate must have good verbal and written communication skills.

Minimum Qualifications

AS 44.62.350 (c) requires that a hearing officer be licensed to practice law for at least two years prior to appointment. While CFEC is exempt from this statutory provision, this licensure is preferred, as is experience working with laws and regulations relative to the commercial fishing industry.

This is a fully exempt job class under AS 39.25.110(D)
