Job Description

Are you an experienced leader with a passion for regulatory compliance and strategic legal coordination? The Utah Division of Real Estate is seeking a dynamic and strategic professional to serve as its Chief Investigator.

This high-level role focuses on the strategic direction, legal coordination, and external defense of the Division's enforcement and compliance programs across multiple industries, including real estate, mortgage, timeshare, and appraisal professionals.

This position will be in the office for at least the first six months

, and then may be able to telework up to two days per week (if eligibility requirements are met).





ROLES AND RESPONSIBILITIES



The Chief Investigator leads a dedicated team, ensuring adherence to regulatory standards and strengthening public trust in Utah's real estate industry through efficient, fair, and effective enforcement.Your leadership of this team will include, but not be limited to, the following:Supervising subordinate personnel, including hiring, determining workload, and delegating assignments, training, monitoring, and evaluating performance, and initiating corrective or disciplinary actions; Overseeing investigations into allegations of a variety of inappropriate activities, regulatory violations, or illegal actions; Recommending, advocating for, and/or implementing new and or changes to existing policies and procedures, laws, or regulations based on emerging enforcement trends and issues; Preparing cases and ensuring they are ready for referral to the Division's counsel, the Utah Attorney General's Office; Coordinating and/or acting as a liaison between the Division and the Utah Attorney General's Office, other agencies, organizations, etc.; Auditing and reviewing processes to ensure compliance with procedures, regulations, and standards; Representing the Division at interprofessional, team, and/or agency meetings; Representing the Division at legislative and administrative hearings, including defense of enforcement policy; Reviewing pleadings, stipulations, orders, and other documents used in administrative proceedings; Acting as a witness as required in criminal, civil, and administrative hearings; Delivering presentations, stand-up training, or instruction to staff, management, licensees, or the general public; Responding to incoming questions, providing information, explaining policy and procedures, and/or facilitating a resolution; Monitoring agency budget, including revenues, expenditures, and use of specific funds; and Interacting with staff, leadership, and general membership of the Utah State Legislature.

THE IDEAL CANDIDATE




Our ideal candidate will have:

Proven ability to lead, supervise, and motivate a team, including delegating tasks, conducting performance evaluations, and handling disciplinary actions. The capability to exercise sound judgment in managing the sensitive administrative and operational functions of a high-profile regulatory/enforcement unit. Excellent technical writing skills. Strong analytical skills in determining violations of the law. In-depth understanding of state and federal laws, with the ability to lead the development, defense, and implementation of new policies, rules, and legislation based on emerging enforcement trends. Excellent communication and public speaking skills to represent the Division effectively, including public advocacy, interacting with State Legislators, and defending administrative policy to a wide range of public and private stakeholders. Strong organizational skills to plan, implement, coordinate, and monitor Division enforcement and compliance programs. The capability to act in the absence of the Division Director and manage unexpected challenges effectively. Ability to work cooperatively within a larger department, fostering a collaborative and supportive work environment.

MINIMUM QUALIFICATIONS



A minimum of three years of experience in a regulatory compliance, enforcement, or investigative role.

PREFERRED QUALIFICATIONS



Juris Doctor (J.D.) degree from an accredited law school (equivalent preference will be given to 3-5 or more years of experience with advanced analysis and research, drafting complex technical proposals, and responsibility for financial or regulatory compliance). Bachelor's degree in business or criminal justice (equivalent preference will be given to 3-5 or more years of investigative experience). Prior management experience. Professional experience in real estate, appraisal, mortgage, timeshare, and/or land sales. Current Department of Commerce employees.
